1. Acceptance of Terms

By accessing or using MarginStack ("the Service"), operated at marginstack.io, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

MarginStack is a web-based tool that provides estimated landed cost calculations for products imported into the United States, including estimates of customs duties, freight costs, and Amazon FBA fees. The Service is designed for informational and planning purposes only.

3. Important Disclaimers About Calculations

All cost calculations, duty estimates, tariff rates, and fee projections provided by MarginStack are estimates only. They are not guaranteed to be accurate, complete, or current.

In particular, you acknowledge that:

• Final duty determinations are made exclusively by U.S. Customs and Border Protection (CBP). MarginStack has no authority to make binding classifications or duty assessments.
• Tariff rates, trade policies, and fee schedules are subject to change without notice due to executive orders, legislative action, court rulings, or agency reclassification.
• HS code suggestions provided by the Service (including AI-powered classifications) are informational only and do not constitute official customs classification.
• Amazon FBA fee estimates are based on published rate cards and may not reflect your actual fees, which depend on your seller account terms, product dimensions as measured by Amazon, and current fee schedules.
• You should consult a licensed customs broker for official classification and binding rulings specific to your products.

4. Not Customs Brokerage

MarginStack does not provide customs brokerage services as defined under 19 U.S.C. § 1641. The Service does not file customs entries, make binding classifications, or pay duties on your behalf. Nothing in the Service should be construed as customs brokerage, legal advice, tax advice, or financial advice.

5. User Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to the Service, other user accounts, or any systems or networks connected to the Service.
• Use automated scripts, bots, or scraping tools to access the Service beyond what is provided through our documented interfaces.
• Resell, redistribute, or sublicense access to the Service without written permission.
• Interfere with or disrupt the integrity or performance of the Service.

7. Subscriptions and Billing

MarginStack offers both free and paid subscription tiers. Paid subscriptions are billed on a recurring monthly basis through our payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on each billing cycle until you cancel.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial billing periods.

8. Intellectual Property

The Service, including its design, code, content, and branding, is owned by MarginStack and protected by applicable intellectual property laws. You retain ownership of any data you input into the Service.

9. Limitation of Liability

To the maximum extent permitted by law, MarginStack and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, or business opportunities, arising from your use of or inability to use the Service.

MarginStack's total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

You acknowledge that import duty calculations involve inherent uncertainty and that you bear ultimate legal responsibility for accurate customs classification and duty payment for your imports.

10. Indemnification

You agree to indemnify and hold harmless MarginStack and its operators from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles.
